The Archives of the Military Courts from 1945 to 2004



The Military Justice and Judicial Department established way back in 1839, ceased to exist on December 31, 2004. In April 2005, the Military Archives took over the archival materials of the Military Justice and Judicial Department (registers and cases) by the adoption of the Law on transfer of jurisdiction of military courts, military prosecution and military attorney to the member countries authorities (“Official Gazette of Serbia and Montenegro“, No. 55/04) and Regulation on the manner and procedure of handing over cases, objects and persons by military courts, military prosecution and military establishment for execution of criminal sanctions to the member countries authorities (“Official Gazette of Serbia and Montenegro“, No. 62/04, 4/05).

Archival materials of the Military Justice is open for research according to single requests of legal entities and individuals by justified interest in a particular procedure. according to Articles 20 and 21 of the Law on archival material of the Federal Republic of Yugoslavia (“Official Gazette of FRY” No. 12/98 and 13/98) and appropriate orders of the Law on Personal Data Protection (“Official Gazette of the Republic of Serbia“, No. 97/08, 104/09, 58/10 and 87/18 with the commencement date August 21, 2019).

For handling requests of legal entities and individuals that have the character of requests for free access to information of public importance, an authorized person from the Legal Department of the Secretariat of the Ministry of Defence, as the legal successor of the Military Justice and Judicial Department, has been determined by the Order of the Minister of Defence, according to the Article 38, paragraph 1 of the Law on free access to information of public importance (“Official Gazette of the Republic of Serbia“, No. 120/04, 54/07, 104/09 and 36/10).
